This Privacy Policy explains how BYTECOMPUTE, INC., a Delaware corporation (“ByteCompute,” “Company,” “we,” “our,” or “us”), collects, uses, discloses, retains, and protects information when you access or use our websites, application programming interfaces (“APIs”), AI infrastructure, communications functionality, and other products and services (collectively, the “Services”).
By accessing or using the Services, you acknowledge the practices described in this Privacy Policy. Capitalized terms not defined here have the meanings given in our Terms of Service.
1. Scope
This Privacy Policy applies when you visit bytecompute.ai, create or use an account, use our APIs, use our AI infrastructure or model services, communicate with us, or use communications features made available through the Services.
The Services are intended primarily for business and commercial users. In some circumstances, our customers may use the Services to process information concerning their own customers, users, callers, or other recipients (“End Users”). When a customer determines the purposes and means of processing End User information, that customer is responsible for its own privacy notices, legal bases, consents, and other obligations under applicable law.
2. Data Submitted to and Returned by Our API and AI Services
Inputs submitted to our APIs, models, or other AI Services and the resulting outputs may contain personal information or other confidential information supplied by you.
Unless you specifically request a feature that requires storage or model training or fine-tuning, or otherwise authorize us to do so, we do not use your API inputs or outputs to train our general models. We may temporarily process or retain limited API inputs, outputs, logs, or related technical information when reasonably necessary to operate the Services, troubleshoot incidents, prevent abuse, comply with law, or provide support.

3. Information We Collect
3.1 Account and Profile Information
When you create or manage an account, we may collect information such as your name, email address, company or organization information, billing profile, account preferences, and authentication or security information.
3.2 Communications and Support Information
We may collect information you provide when you contact sales, support, or other ByteCompute teams, submit inquiries or feedback, register for events, complete surveys, participate in promotions, or otherwise communicate with us. We may retain records of those communications and the information you provide.
3.3 Transaction and Billing Information
We may collect transaction records, subscription or usage information, invoices, billing status, and related payment information. Payment information may be processed by third-party billing or payment providers. We do not necessarily receive or store complete payment-card details.
3.4 Information You Submit Through the Services
We collect information that you choose to submit through forms, APIs, model requests, support requests, communications features, or other parts of the Services. The categories of information depend on the feature you use.
The Services are not intended for the submission of protected health information subject to HIPAA, payment-card data subject to PCI DSS, government identification numbers, financial account credentials, biometric identifiers, or information concerning individuals under 18, and you should not submit such information unless the applicable Service expressly supports it under a separate written agreement.
3.5 Information From Third Parties
We may receive information from service providers, business partners, communications providers, identity or verification providers, fraud-prevention providers, and other third parties when reasonably necessary to operate, secure, bill for, or support the Services.
4. Information Collected Automatically
When you access or use the Services, we may automatically collect technical and usage information, including:
- IP address and approximate network location;
- browser, device, and operating-system information;
- dates, times, and duration of access;
- pages, features, APIs, or resources accessed;
- request, response, error, and diagnostic information;
- security and authentication events; and
- cookie, local-storage, or similar technology identifiers where used.
We may use cookies and similar technologies to operate the Website, remember preferences, understand usage, improve the Services, and support security. Your browser may allow you to block or delete certain cookies, although doing so may affect functionality.
5. How We Use Information
We may use information we collect to:
- provide, operate, maintain, and improve the Services;
- create, authenticate, secure, and administer accounts;
- process requests, API calls, transactions, billing, and support inquiries;
- send service, security, billing, and account-related notices;
- provide features and functionality requested by customers;
- monitor performance, troubleshoot issues, and maintain reliability;
- detect, investigate, and prevent fraud, spam, abuse, unauthorized access, and other security risks;
- comply with applicable legal, regulatory, telecommunications, and contractual requirements;
- enforce our Terms of Service and other agreements;
- analyze usage and improve our products and user experience; and
- carry out other purposes disclosed at the time of collection or with your consent.
6. Communications Services
We may provide communications functionality as part of the Services, including SMS and MMS messaging, voice calling, telephone numbers, call recording, transcription, and related communications processing (collectively, “Communications Services”).
Communications Services may include (i) communications sent directly by us to our users or customers and (ii) functionality that enables our customers to communicate with their own End Users.
We use third-party communications service providers, including Twilio Inc. and its affiliates (“Twilio”), telecommunications carriers, network operators, and other service providers to provide certain Communications Services.
6.1 SMS Communications From Us
If you affirmatively opt in to receive SMS messages from us, we may use the mobile telephone number you provide to send communications relating to your account, transactions, security, billing, customer support, service activity, service notifications, or other purposes disclosed when you provide consent.
Participation in optional SMS communications is voluntary. Consent to receive optional SMS messages is not a condition of purchasing or using Services that do not require SMS communications.
Message frequency may vary depending on the applicable service, your account activity, and the types of communications you have elected to receive. Message and data rates may apply.
You may opt out of applicable SMS communications at any time by replying STOP to a message or by using another opt-out method that we make available. Where supported, you may reply HELP for assistance.
After you opt out, we may send one final confirmation message acknowledging your request. We will not send further messages covered by the withdrawn consent unless you subsequently opt in again.
6.2 SMS Consent and Preference Information
Where required or appropriate, we may maintain records relating to SMS consent and preferences, including mobile telephone numbers, the date and time consent was provided or withdrawn, the method by which consent was obtained, the consent language or version presented, the applicable messaging program or use case, and related compliance information.
We use this information to manage messaging preferences, honor opt-out requests, maintain suppression records, investigate complaints, and comply with applicable messaging, carrier, legal, and regulatory requirements.
6.3 Customer Messaging Services
Customers may use the Communications Services to send SMS, MMS, or other communications to their own End Users and may be provided with or permitted to use telephone numbers or messaging capabilities made available through us or our communications service providers.
When customers use these features, we may process mobile telephone numbers, sender and recipient information, message content, timestamps, routing information, delivery and failure information, consent and opt-out status, communications preferences, and other technical, operational, security, fraud-prevention, registration, or compliance-related information.
We may process this information to route and deliver messages, provide telephone numbers and messaging functionality, maintain consent and opt-out status, troubleshoot delivery, prevent fraud and abuse, support registration and verification, provide customer support, and comply with applicable requirements.
6.4 Mobile Information and Marketing
We do not sell or rent mobile telephone numbers or SMS opt-in or consent information.
Mobile information, including mobile telephone numbers and SMS opt-in or consent information, will not be shared with third parties or affiliates for their own marketing or promotional purposes.
We may disclose mobile information to service providers and other parties where reasonably necessary to provide and support the Communications Services, including communications platforms, telecommunications carriers, network operators, messaging aggregators, registration entities, infrastructure providers, and other vendors that assist us in operating the Services. Such disclosures are made for service delivery, number provisioning, operations, security, fraud prevention, troubleshooting, regulatory compliance, messaging registration, or customer support, and not for those parties' independent marketing or promotional purposes.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories of information described in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
SMS opt-in data and consent will not be shared with third parties for their own marketing or promotional purposes.
6.5 Voice Communications
If you or an End User uses voice calling functionality through the Services, we may process information associated with the call, including calling and called telephone numbers, caller identification information, call date and time, duration, call status, routing and technical information, delivery or failure information, and information voluntarily provided during the call.
We process this information to provide and operate voice functionality, route calls, maintain service records, provide support, prevent fraud and abuse, troubleshoot service issues, and provide functionality requested through the Services.
Some calls handled through the Services may be answered or conducted by an automated voice agent using artificial intelligence. In those cases we may additionally process the audio of the conversation, its transcript, and information derived from it in order to generate responses and provide the functionality requested by our customer. Our customers are responsible for disclosing to call participants that they are interacting with an automated system where such disclosure is required by applicable law.
6.5a Emergency Calling Information
Telephone numbers and voice functionality made available through the Services do not support access to 911 or other emergency services unless we have expressly enabled emergency calling for a specific number in writing.
Where emergency calling is expressly enabled for a number, we collect and store the registered physical address associated with that number and, when an emergency call is placed, transmit that address and an associated callback number to the emergency call routing provider, the relevant public safety answering point, and emergency responders. We may retain records of emergency calls, including the number, address, date, time, and routing information, as required by applicable telecommunications regulations. Customers are responsible for providing and keeping current an accurate registered address for each number and for informing their own users and End Users of the limitations described in our Terms of Service.
6.6 Call Recording and Transcription
Certain Communications Services may allow calls to be recorded, transcribed, monitored, or otherwise processed. When these features are enabled, we or our service providers may collect, process, and store audio recordings, transcripts, call-participant information where available, timestamps, and information contained in or derived from recorded or transcribed communications.
Recording and transcription functionality may be used to provide requested services, maintain records, assist with customer service, facilitate transactions or appointments, improve service quality, troubleshoot issues, prevent fraud or abuse, or provide other functionality requested by our customers.
Our customers are responsible for providing legally required notices and obtaining legally required consents before recording, transcribing, monitoring, or otherwise processing communications with their End Users. Because U.S. call-recording and communications-privacy laws may vary by state and by the location of call participants, customers must ensure that their use of these features complies with applicable requirements.
6.7 Information Extracted From Communications
The Services may process messages, calls, recordings, or transcripts to identify, organize, extract, summarize, or generate structured information necessary to provide requested functionality.
Depending on the communication and use case, this information may include names, telephone numbers and other contact information, appointment dates and times, reservation or scheduling information, products or services requested, customer inquiries, instructions or preferences, transaction-related information, and other information voluntarily provided during a communication.
For example, when an End User calls to schedule an appointment, the Services may process the conversation or transcript to identify the End User's name, contact information, requested service, and preferred appointment date and time.
6.8 Customer Responsibility for End User Communications
Our customers generally determine the recipients, content, purpose, and use cases for communications they initiate or receive through the Communications Services. Customers are responsible for obtaining and maintaining consents, permissions, and authorizations required to communicate with End Users and to record, transcribe, analyze, or otherwise process their communications.
Customers are also responsible for complying with applicable privacy, telecommunications, messaging, call-recording, consumer-protection, and other applicable laws and requirements.
6.9 Communications Service Providers
As reasonably necessary to provide the Communications Services, communications-related information may be transmitted to or processed by Twilio, telecommunications carriers, network operators, messaging aggregators, registration entities, infrastructure providers, and other service providers involved in registering, routing, delivering, recording, transcribing, securing, monitoring, or supporting communications.
6.10 Communications Data Retention
We retain communications-related information for as long as reasonably necessary to provide and operate the Services, fulfill the purposes described in this Privacy Policy, comply with legal or regulatory obligations, resolve disputes, prevent fraud or abuse, and enforce our agreements.
Communications-related information is stored in the United States.
Different types of communications information may be retained for different periods. For example, call recordings or transcripts may be retained for a different period than information extracted from those communications, such as appointment or transaction records. Retention may also depend on customer settings, contractual requirements, technical requirements, and applicable law.
6.11 SMS Opt-Out and Suppression Information
We and our communications service providers may maintain information indicating whether a telephone number has opted in to or opted out of particular messaging communications. If a recipient withdraws consent or requests that messages stop, we may retain limited information reasonably necessary to honor and enforce that request, manage suppression records, resolve complaints, and demonstrate compliance.
6.12 Your Communications Choices
You may choose whether to participate in optional SMS communications offered by us. Where consent is the basis for sending SMS communications, you may withdraw that consent using the opt-out methods described above. Withdrawal of optional SMS consent will not affect your ability to use portions of the Services that do not require SMS communications.
7. Disclosure of Information
We may disclose information in the following circumstances:
- Service providers. To vendors and providers that help us operate, secure, support, bill for, or deliver the Services.
- Customer-directed processing. To third-party endpoints, models, infrastructure, or providers selected or required in connection with a customer's requested use of the Services.
- Communications providers. As described in the Communications Services section above.
- Legal and regulatory requirements. To comply with law, court orders, legal process, governmental or regulatory requests, or telecommunications requirements.
- Protection and enforcement. Where reasonably necessary to protect ByteCompute, our customers, End Users, the public, or the Services; prevent fraud or security incidents; or enforce our agreements.
- Business transfers. In connection with a merger, financing, acquisition, reorganization, sale of assets, bankruptcy, or similar transaction, subject to applicable legal requirements.
- With consent. For other purposes with your direction or consent.
We may disclose aggregated or de-identified information that does not reasonably identify an individual, subject to applicable law.
8. Your Choices Regarding Information
- Cookies and tracking technologies: You may configure your browser to block or delete cookies, although some Services may not function properly.
- Marketing email: You may unsubscribe from promotional email using the instructions included in the communication. We may still send important non-promotional service, security, billing, or account notices.
- SMS: If you have opted in to optional SMS messages from us, you may opt out as described in Section 6.
- Account information: You may update certain account information through your account settings where available.
9. Access, Correction, Deletion, and State Privacy Rights
Depending on where you reside and subject to applicable exceptions, you may have rights to request access to, correction of, deletion of, or portability of certain personal information, or to opt out of certain processing such as sale, sharing, targeted advertising, or profiling where applicable.
U.S. state privacy laws may provide additional rights to residents of states including California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, Virginia, and other states as their laws take effect or are amended.

10. Data Retention
We retain personal information for as long as reasonably necessary to provide the Services, maintain accounts, comply with legal, tax, accounting, regulatory, telecommunications, security, and contractual obligations, resolve disputes, prevent fraud or abuse, and enforce our agreements.
Retention periods vary by category of data and purpose. Account information may be retained for a limited period after account closure where reasonably necessary for fraud prevention, legal compliance, billing reconciliation, or dispute resolution. Communications data is handled as described in Section 6.10.
11. Data Security
We use administrative, technical, and organizational safeguards designed to protect information against accidental or unlawful loss, misuse, unauthorized access, alteration, and disclosure. These measures may include access controls, encryption, monitoring, network protections, and security procedures appropriate to the nature of the information and Services.
No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your passwords, API keys, and other authentication credentials and for promptly notifying us of suspected unauthorized access.
12. Data Location and International Transfers
ByteCompute is a United States company and the Services are operated from the United States. Personal information and other data processed through the Services, including account information, API inputs and outputs, and communications data such as messages, call records, recordings, and transcripts, are stored and processed in the United States.
We do not transfer this data outside the United States for storage, and we do not engage in cross-border transfers of customer or End User data as part of providing the Services.
Our service providers that process data on our behalf, including our communications providers, process that data in the United States for the purposes described in this Privacy Policy. Where a provider or carrier must route a communication internationally to complete delivery at a customer's direction, that routing is performed by the relevant telecommunications networks and is inherent to the delivery of the communication.
If you access the Services from outside the United States, you understand that your information will be processed in the United States, where data protection laws may differ from those of your jurisdiction.
13. Children Under 18
The Services are not intended for individuals under 18 years of age, and we do not knowingly collect personal information directly from children under 18. If you believe a child has provided personal information to us without appropriate authorization, contact us at [email protected].
14. California Privacy Notice
California residents may have rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, subject to applicable thresholds, definitions, and exceptions.
Depending on how the law applies to you and to ByteCompute, these rights may include the right to know or access categories or specific pieces of personal information, request correction or deletion, obtain information about disclosures, and opt out of certain sales or sharing.

Retention of each category is described in Sections 6.10 and 10. We do not use or disclose sensitive personal information for purposes other than those permitted under the CCPA without providing notice and, where required, the ability to limit such use.
14.2 Sale and Sharing of Personal Information
ByteCompute does not sell personal information and does not share personal information for cross-context behavioral advertising, as those terms are defined under the CCPA. We have not sold or shared personal information in the twelve months preceding the date of this Privacy Policy, and we do not sell or share the personal information of individuals we know to be under 16 years of age.
ByteCompute does not sell mobile telephone numbers or SMS opt-in or consent information, and does not share such information with third parties or affiliates for their own marketing or promotional purposes.
14.3 Service Provider Relationship
Where our customers use the Services to process personal information about their own End Users, we generally act as a service provider or processor and process that information only on the customer's documented instructions and for the purposes described in our agreement with that customer. Requests from End Users to exercise privacy rights in respect of that information should be directed to the relevant customer, and we will provide reasonable assistance to that customer in responding.
14.4 Exercising Rights
To exercise an applicable right, contact us at [email protected]. We do not discriminate against individuals for exercising applicable privacy rights. Authorized agents may submit requests where permitted by law, subject to verification requirements.
15. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our Services, practices, legal requirements, or other circumstances. When we make material changes, we may provide notice through the Services, by email, or by another appropriate method. The “Last updated” date at the top of this page indicates when this Privacy Policy was most recently revised.
